Terms of Use
Read this bit. JimHell is a training log, not a doctor. Check with a doctor before you start training hard, listen to your body, and stop if something feels wrong. You train at your own risk.
1. The agreement
These terms are an agreement between you and the developer of JimHell (“we”, “us”) for the JimHell iPhone and Apple Watch apps, this website and the services behind them. By using JimHell you accept them; if you don’t, please don’t use the app. Our privacy policy explains how we handle your data.
2. Not medical advice
JimHell is a fitness tool. It is not a medical device, and nothing in it — heart-rate zones, scores, tiers, targets or anything else — is medical advice, a diagnosis or a recommendation of treatment.
- Talk to a doctor before starting or changing an exercise programme, especially if you have a heart condition, high blood pressure, diabetes or an injury, are pregnant, or haven’t trained in a while.
- Stop immediately and get medical help if you feel chest pain, dizziness, faintness, unusual shortness of breath or any other warning sign.
- The numbers are estimates. Heart rate and energy come from your devices and can be inaccurate; scores are our own calculation, not a measure of your health.
- Your risk. You choose your exercises, weights and intensity, and you’re responsible for training safely, using equipment properly and having a spotter when you need one. You use JimHell at your own risk.
3. Your account
You must be at least 13 years old (or the minimum age in your country) to use JimHell. You sign in with Apple or Google; keep your devices and those accounts secure, because you’re responsible for what happens under your JimHell account. You can delete your account inside the app at any time.
4. Acceptable use
Use JimHell for your own training and play fair. Don’t:
- break the law, or use JimHell to harm anyone;
- try to get into other people’s accounts or data, or parts of the service you’re not meant to reach;
- attack, overload, scrape, probe or disrupt our servers, or reverse-engineer the app except where the law allows it;
- post cards or captions that are illegal, hateful, harassing, sexually explicit or violent, or that infringe anyone else’s rights;
- impersonate anyone, or use the service to send spam.
We may remove content, and suspend or close accounts, that break these rules.
5. Your content
Your workouts are yours. You let us store and process them only as needed to run JimHell for you. When you share a card, you let us host it at a public link and show it to anyone who opens that link, for as long as you keep your account.
6. Paid features
JimHell is free to use today. We may later offer optional paid features or subscriptions. If we do, they’ll be sold through Apple’s In-App Purchase: the price is shown in the app before you buy, Apple handles payment, renewals and refunds under its own terms, and you can manage or cancel a subscription in your Apple account settings. We’ll never charge you for something you didn’t choose to buy.
7. Apple
These terms are between you and us, not Apple. Apple isn’t responsible for JimHell or its content, has no obligation to provide maintenance or support for it, and isn’t responsible for any claims relating to it — including product liability, legal or regulatory claims, or intellectual-property claims; those are ours to handle as these terms and the law provide. If JimHell fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. You confirm that you’re not located in a country subject to a U.S. Government embargo, and not on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple’s standard Licensed Application End User License Agreement also applies to your use of the app.
8. The service
We work hard to keep JimHell running and your data safe, but we can’t promise it will always be available, uninterrupted or error-free. We may change, add or remove features. If we ever shut JimHell down, we’ll give you reasonable notice and a way to get your data.
9. Liability
To the fullest extent the law allows, JimHell is provided “as is”, without warranties of any kind, and we’re not liable for indirect, incidental or consequential losses, or for injury resulting from exercise you choose to do. Nothing in these terms limits liability that can’t legally be limited — such as for death or personal injury caused by our negligence, or for fraud — or takes away your statutory rights as a consumer.
10. Ending
You can stop using JimHell and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms.
11. Changes
We may update these terms. We’ll change the date at the top, and tell you in the app before significant changes take effect. Continuing to use JimHell after that means you accept the new terms.
